This Privacy Notice describes how Invoy Technologies, LLC, Invoy Weight Loss, LLC, and its subsidiaries and affiliates (collectively "Invoy," "we," "us") collects, processes, uses, discloses, and secures information through its mobile application (the "Voyager Mobile App"), its web service ("Portal"), and its websites including http://www.invoy.com (the "Website") (collectively the "Web Services"). The Web Services are provided in conjunction with the use of the Voyager System, which is only distributed to adult Clients of Invoy Weight Loss, LLC. Use of the Voyager System and collection of data from such use is limited to adults who are over 18 years of age.
There are many different ways You can use the Voyager System: to obtain Your Ketone Score, to obtain Your trended Ketone Score, to journal daily progress metrics, and to email Your results. In order to deliver the Voyager System to You, we require You to consent to the collection and processing of Your personal information when You initially begin using the Voyager System. Your information is stored in two locations: Your mobile device and Invoy's secure, encrypted cloud server, resident server or web server. As You use the Voyager System, we want You to be clear about how we are using information and the ways in which You can protect Your privacy.
Our Privacy Notice explains:
- What information we collect and why we collect it.
- How we use that information.
- The choices we offer regarding our use of the information.
- The measures we take to protect the security of the information.
We've tried to keep it as simple as possible, but if You're not familiar with terms like cookies, IP addresses, pixel tags and browsers, then read about these key terms first.

Information We Collect
"Personal Information" means any information collected from Your use of the Voyager System, from You personally, or from Invoy Weight Loss, LLC. Examples of Personal Information include such things as Your name, email address and other contact information. It also includes information that You create or input as You use the Voyager System, such as profiles that You create, including the information You input into such profiles, information about Your products or services that You order, Your inquiries to us, credit card information, preferences, and the like.
We may collect the following types of Personal Information from You in conjunction with Your use of the Voyager System, and store it on Your mobile device and in the Invoy database:
- Your contact information (such as Your name, postal address, email address, and mobile or other telephone number);
- Your weight loss coach's contact information;
- Your username and password;
- Information from Your customer support inquiries;
- Demographic information (e.g., Your date of birth and gender);
- Any health or medical information that You or Your weight loss coach provides. PLEASE NOTE THAT THIS MAY BE INFORMATION THAT YOUR WEIGHT LOSS COACH SHARES WITH US THROUGH THEIR ELECTRONIC MEDICAL RECORDS (EMR), INCLUDING WITHOUT LIMITATION INFORMATION ABOUT MEDICATIONS YOU ARE TAKING AND HEALTH HISTORY INFORMATION;
- Payment information (such as Your payment card number, expiration date, delivery address, and billing address); and
- Information collected by the Voyager System, including Personal Information (such as Ketone Score or breath analyte data from Your Voyager Base Unit including the breath measurement itself).
When You use the Web Services or open our emails, we may collect certain information by automated means, such as Cookies, Web Beacons and Web Server Logs. The information we collect in this manner includes Your IP address, browser characteristics, device characteristics, operating system version, language preferences, referring URLs, information on actions taken on the Web Services, and dates and times of the Web Service visits. If You continue to use the Web Services, we will assume that You permit this collection.
A Cookie is a file that websites send to a visitor's computer or other Internet-connected device to uniquely identify the visitor's browser or to store information or settings in the browser. A Web Beacon, also known as an Internet tag, pixel tag or clear GIF, links web pages to web servers and their Cookies and may be used to transmit information collected through Cookies back to the Web Server. Through these automated collection methods, we obtain 'clickstream data,' which is a log of the links and other content on which a visitor clicks while browsing a website and identifies the prior website used to access the Web Services. As the visitor clicks through the Web Services, a record of the action may be collected and stored.
We may obtain this information directly or other third party services providers, including Google Analytics. (To see how Google uses this data, go to www.google.com/policies/privacy/partners. If You want to disable this function on Your computer, You can change Your browser setting to disallow Cookies. Please note, however, that some features of the Web Services may not function properly without Cookies enabled.) This data can then be used to tailor this content of the Web Services, deliver a better experience for our visitors and manage our advertising. We may also collect, aggregate and maintain anonymous information about the visitors to the Web Services. We may further share such aggregate information about our visitors with advertisers, business partners, sponsors and other third parties. Because of the changing state of technology and indecision within the industry regarding the meaning of Do Not Track signals, we currently do not honor Do Not Track signals delivered by Your browser.
We may use other third-party services in a similar manner in conjunction with the Web Services to collect usage data in order to understand how visitors are using the Web Services and to gather information that will be used to improve the Web Services of the products.
How We Use the Information We Collect
To the extent permitted by law, we may use the information we collect to:
- Improve the quality of the Voyager System readings, as well as fat metabolism measurement methods in general, and develop knowledge of fat metabolism phenomena through use of Your Personal Information, alone or in combination with that of others;
- Create and manage user accounts for the Web Services;
- Efficiently and effectively provide Invoy products and services;
- Give You and Your weight-loss coach access to the breath analysis data collected from the Voyager System;
- Deliver and manage customer support and respond to inquiries;
- Process payments;
- Update You on promotional materials or other communications, communicate about, and administer participation in, special events, programs, offers, surveys and market research;
- Perform data analyses (including de-identification and aggregation of Personal Information);
- Operate, evaluate and improve our business (including developing and commercializing existing and new products and services; enhancing and improving our services; managing our communications; analyzing our products; and performing accounting, auditing and other internal functions);
- Aggregate and de-identify Your Personal Information and images and use and share the resulting data for business purposes (for example, to provide beneficial health-related data not limited to statistics, trending and services to Invoy affiliates);
This Privacy Notice does not apply to Personal Information we collect from other sources. We may combine or cross-reference Your Personal Information with other information we may have acquired about You or may acquire about You through third-party sources, other than Google, as permitted by such sources and under the law to help further customize the information, products or services we provide to You. You may request deletion of Your Personal Information by us, but please note that we may be required (by law or otherwise) to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with Your deletion request only after we have fulfilled such requirements). When we delete Personal Information, it will be deleted from the active database, but may remain in our archives and we may also retain General Information about Your use of the Voyager System. Once we disclose some of Your Personal Information to third parties, we may not be able to access that Personal Information any longer and cannot force the deletion or modification of any such information by the parties to whom we have made those disclosures. After we delete Personal Information, we will retain de-identified data and will continue to use de-identified data as permitted under this Privacy Notice and to the extent permitted by law.
Information We Share
We do not sell or otherwise disclose Personal Information we collect about You, except as described in this Privacy Notice. We do not rent, sell, or share Personal Information about You with other people or nonaffiliated companies for their direct marketing purposes, unless we have Your permission.
We share Your Personal Information only with You and Your designated weight loss coaches that are associated with Your account (e.g., the coaches that enrolled You) or others that You choose to affiliate.
We also may share Personal Information with vendors and service providers who perform services for us in connection with the provision of the Voyager System based on our instructions. Examples of these vendors and service providers include entities that analyze breath analysis data, process credit card payments, fulfill orders and provide web hosting services. We do not authorize these vendors or service providers to use or disclose any Personal Information except as necessary to perform services on our behalf or comply with legal requirements.
In addition, we may access, preserve, and disclose information about You: (i) if we are required to do so by law or legal process, (ii) to law enforcement authorities or other government officials, (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity, and (iv) to protect Your, our, or others' rights, property or safety.
In the event we sell or transfer all or a portion of our business or assets (including in the event of a reorganization, dissolution or liquidation), such assets likely will include the Personal Information and General Information we retain which we have collected from You and from Your use of the Voyager System. We will use reasonable efforts to direct any transferee that receives these assets to use Personal Information You have provided to us in a manner that is consistent with this Privacy Notice. Following such a sale or transfer, You may contact the entity to which we transfer Your Personal Information with any inquiries concerning the processing of that Personal Information.
To the extent permitted by law, we may transfer Personal Information we collect about You to countries other than the country in which the Personal Information originally was collected.
How We Keep Your Information Secure
We seek to safeguard the security of Your Personal Information but we cannot guarantee the absolute security of Your Personal Information, nor can we guarantee that information that You provide will not be intercepted while being transmitted to us over the Internet. Despite our efforts to protect Your Personal Information, there is always some risk that an unauthorized third party may find a way around our security systems or that transmissions of Your Personal Information over the Internet will be intercepted. Therefore, we urge You to take every precaution to protect Your Personal Information when You are on the Internet.

The Web Services may provide links to other websites and applications for Your convenience and information. These websites and applications may operate independently from us. Linked sites and applications may have their own privacy notices or policies, which we strongly suggest You review. To the extent any linked websites or applications are not owned or controlled by us, we are not responsible for the sites' or applications' content, any use of the sites or applications, or the privacy practices of the sites or applications.
Updates to Our Privacy Notice
This Privacy Notice may be updated periodically and without prior notice to You to reflect changes to our information practices. We will post a prominent notice on the Web Services to notify You of any significant changes to our Privacy Notice and indicate at the top of the notice when it was most recently updated. Where required by law, we will seek Your explicit consent to specific changes. You agree that Invoy will reserve the right to occasionally notify You via email of any important changes to this Privacy Notice and/or Service agreements.
